Privacy Practices & HIPAA Notice

Alice’s Helping Hands is committed to protecting your privacy and personal health information. We adhere to the Health Insurance Portability and Accountability Act (HIPAA) as well as applicable Maryland state regulations governing medical record confidentiality, access, retention, and disclosure.

 

Privacy & Use of Your Information

We use your Protected Health Information (PHI) only as needed to provide care, communicate with your healthcare providers, process billing, and fulfill legal obligations.

We follow the HIPAA principle of “minimum necessary”, sharing only what’s essential for the purpose.

If we share PHI with a third-party partner, we ensure a Business Associate Agreement (BAA) is in place to safeguard your information. 

 

State-Specific Practices in Maryland

Record Retention: We keep medical records for at least 5 years from creation, or until the patient is age 21 plus additional years if the patient was a minor—whichever is longer. 

Storage & Security: Records—whether paper or electronic—are securely stored with restricted access, encrypted systems, and regular backups to prevent loss, damage, or unauthorized access. 

Access & Corrections: You have the right to request and review your medical records. If you request corrections, we will make changes or notify you if we decline, and allow you to add a statement of disagreement. 

Copying Records: If copying is requested, reasonable fees may apply (e.g., up to 76¢ per page, preparation fees, postage), but certain requests—such as those for filing disability benefits—cannot be charged more than $20 per 100 pages.

 

Permitted Disclosures Without Your Authorization

We may share your medical information without your written consent only in specific, legally permitted situations, such as:

With care team members, legal counsel, or insurers for care, payment, or operations

In emergencies, or when state/federal laws require disclosure (e.g., public health reporting)

When necessary for internal audits, licensing reviews, or investigations by authorities.

 

Directory Information

If appropriate and permitted, we may share limited directory information—like your name or location—with your consent. You always have the right to limit or prohibit even this disclosure. 

 

Maryland Online Data Privacy (MODPA)

Beginning October 1, 2025, we will comply with the Maryland Online Data Privacy Act, which requires transparent disclosures about any collection, use, or sharing of personal data. This includes providing clear notices and respecting your rights regarding sensitive health information. 

 

Your Privacy Rights

You are entitled to:

Access, review, and obtain copies of your PHI

Request corrections or add statements of disagreement

Restrict certain types of disclosures, including directory information

Receive an accounting of disclosures of your PHI when required

File a complaint—either with us or the U.S. Department of Health and Human Services (HHS)—if you believe your privacy rights have been violated
